2009 Yachting NSW Appeals

The following appeals were heard and decided in 2009. For protection of privacy, the actual names of the boats have been changed to "A" and "B". Appeals regarding Rule 69 infringements are not listed.

	NSW Yachting Association Appeal 2009 02       NSW0902 (Rules 61.1(a), 63.5) The Appeal was dismissed as C has not established any of the grounds it has relied upon in the Appeal. C was required to comply with RRS 61.1(a) which she failed to do. The Appeals Committee confirms the decision of the Protest Committee that C’s protest was invalid and that closing the hearing and not considering the substantive issues alleged in the protest was a correct interpretation of RRS 63.5    NSW Yachting Association Appeal 2009 03       Rule 44.1(b) The Appeal is dismissed. The Appeals Committee supports the Protest Committee’s conclusion that P did not obtain a significant advantage.    NSW Yachting Association Appeal 2009 04       Rule 14(b) The on the ground that S could have taken other action to avoid the contact the Appeal is dismissed. On the ground that the hearing was improper due to the interest of the Chairman, the appeal was dismissed.    NSW Yachting Association Appeal 2009 05       Rule 11 and Defn Keep Clear Appeal Upheld to the extent that the Protest Committee is directed to find additional facts.    NSW Yachting Association Appeal 2009 06           NSW Yachting Association Appeal 2009 07       Request for redress refused as the boat failed the "no fault of her own" test.    NSW Yachting Association Appeal 2009 10       Whether sufficient space was provided to avoid breaching rule 15
